Copyright and Conditions of Use

The express condition of entry to this website is that all visitors are authorised to use the images for research or study only. You are not authorised to use the images for business purposes, or for resale. If you accept these conditions you are welcome to download any of the images.

We have made every effort to trace copyright holders, but in some instances without success. To these we offer our apologies, trusting that they will accept the will for the deed. If anyone believes that his or her copyright has in any way been infringed, please contact us immediately.

We follow the advice of the Australian Copyright Council in believing that:

  • photographs taken before 1 May 1969 have copyright for 50 years from the date they were taken;
  • photographs taken after 1 May 1969 have copyright for 50 years from first publication;
  • artistic works have copyright for the life of the creator plus 50 years;
  • once copyright has expired it cannot be renewed by subsequent republication;
  • any photograph that simply reproduces a work of art that is out of copyright is unlikely to be protected by copyright separate from the original work of art.

Copyright laws changed in Australia on 1 January 2005. The main change appears to be that the 50 year rules mentioned above have increased to 70 years. However, where copyright expired prior to 1 January 2005, it cannot be re-established by this change in the law.

Images here are confined to:
  • those where copyright has expired;
  • those where permission to publish has been obtained from the copyright holder;
  • those where the copyright holder is unknown;
  • examples from publications of the Indonesian government;
  • fotos of David Armstrong.
